Terms of Service

For the purpose of this release / TOS, the client refers to the person who purchased a product from Dark Angel Graphics and the designer refers to Dark Angel Graphics as a single entity

Release:

Upon purchasing a graphic from Dark Angel Graphics, the client is the only one granted use of the final design unless specified by the designer, or the client has purchased extended licensing.

General Terms:

1. Due to license restrictions from stock photography, the full license remains with the designer, not the client. No exceptions.

2. Client agrees to abide by the terms and services and licensing agreement of all stock photography that Dark Angel Graphics uses and purchases for their project. Most stock images are purchased through DepositPhotos, if otherwise the client will be informed. All images are under a standard license unless specifically requested otherwise by the client beforehand. Additional fees apply for extended licensing.

3. Upon purchase, Dark Angel Graphics grants the client limited use of the final design (JPG, PDF, or other provided format.) No PSD or original files can be transferred, client will receive only the final design.

4. Under no circumstance may a client make and sell/gift swag (posters/t shirts/keychains etc…) unless they have purchased the appropriate extended licenses for their design. This is noted under license terms on stock photography websites. Should a client wish to use their final images for anything outside standard licensing rights, a client should contact Dark Angel Graphics first to discuss extended licensing.

 

5. The Client agrees not to alter the final file in any way. If a client needs alterations, they can contact Dark Angel Graphics for necessary changes. Depending on the type of change required, there may be an additional charge. Only Dark Angel Graphics can make alterations unless the client has gained prior written approval.

6. The client understands that:
To the best of Dark Angel Graphics' knowledge, Dark Angel Graphics has provided the client with a unique design, however, because Dark Angel Graphics uses stock imagery that other designers/authors have access to, Dark Angel Graphics cannot be held liable for other designs that contain similar imagery/position/designs, past, present, or future.

7. Dark Angel Graphics is not liable for any damages of any kind, (loss of revenue, profits, business, reputation, data etc) relating to the services and products offered/sold to the client.

8. If the Client is unsure what they can and cannot use their final images for, they can reach out to Dark Angel Graphics.

​

9. Client understands that Dark Angel Graphics is only a designer and not a printer and that all final files are digital.
